Revaluation requests by the end of the year prevent IMI increase in 2022

Quem pretenda pedir uma reavaliação da casa para efeitos de IMI deve fazê-lo até 31 de dezembro para evitar o impacto da subida do preço por metro quadrado (m2) que vai ocorrer em 2022, aconselha o fiscalista Ricardo Reis.

 

De acordo com uma portaria publicada esta segunda-feira, dia 20 de dezembro, o preço do m2 para efeitos de IMI e da avaliação fiscal dos imóveis vai subir para os 640 euros em 2022 – aumentando 25 euros face ao valor que vigorou em 2021.

 

Aquele valor base dos prédios edificados (Vc) de 640 euros corresponde ao valor médio de construção, por metro quadrado, que foi fixado em 512 euros, adicionado de 25%, tal como determina o Código do Imposto Municipal sobre os Imóveis (CIMI).

 

preço do metro quarado de construção é um dos elementos tidos em conta na determinação do valor patrimonial tributário (VPT) dos imóveis, sobre o qual recai o IMI.

Mas, à semelhança do que acontece com outros dos elementos (como os coeficientes de localização, de qualidade e conforto ou de vetustez) também este quadrado não é de aplicação automática, sendo apenas refletido nas construções e casas novas ou nos imóveis alvo de modificação ou de reconstrução (casas reabilitadas) ou na sequência de uma nova avaliação.

 

Desta forma, o novo valor de 640 euros por metro quadrado apenas se aplicará aos prédios urbanos cujas declarações Modelo 1 sejam entregues a partir de 01 de janeiro de 2022, tal como determina a portaria n.º 310/2021 assinada pelo secretário de Estado Adjunto e dos Assuntos Fiscais, António Mendonça Mendes, e publicada em Diário da República.

This request is free of charge, but it must be preceded by a simulation to see if the descent effect that the building's age has on the VPT compensates for the rise that may result from any changes in the location coefficient, or even the price of the square meter, that before the increase announced for 2022 had already increased from 603 euros in 2018 to 615 euros the following year and where it remained until 2021.

 

The rise decided on for 2022 did not surprise inspectors, as this indicator is determined taking into account, namely, the direct and indirect costs borne in the construction of the building, such as those relating to materials, labor.

Although he considers that in the current economic climate it makes no sense to increase the tax, António Gaspar Schwalbach, from the Serra Lopes law firm, Cortes Martins, recalls the rise in prices that has been seen in the construction sector.

 

In addition, he observes, the measure ends up mitigating the tax reduction achieved precisely through the requests for revision of the VPT due to the aging coefficient.

 

Ricardo Reis also points out the rise in construction costs as one of the reasons for the rise in the price of the square meter of construction.
